20 - باب ما جَاءَ في كَراهيةِ بَيْعِ الوَلاءِ وهِبَتِهِ
1280 - حَدَّثَنا محمدُ بن بشارٍ، قال: حَدَّثَنا عبدُ الرحمنِ بن مَهْدِيٍّ، قال: حَدَّثَنا سُفْيانُ وشُعْبَةُ، عن عبدِ اللهِ بنِ دِينارٍ
عن ابنِ عُمَرَ: أنَّ رسولَ الله صلى الله عليه وسلم نَهَى عن بَيْعِ الوَلاءِ وهِبَتِهِ(2).--------------------------------------------
(1) ذكر الفقهاء أنه لا يصح التعاقد على معدوم كبيع الزرع قبل ظهوره، لاحتمال عدم نباته، ولا على ما لَه خطر العدم - أي احتمال عدم الوجود - كبيع الحمل في بطن أمه لاحتمال ولادته ميتًا، وكبيع اللبن في الضرع، لاحتمال عدمه لكونه انتفاخًا، وقد استثنوا من قاعدة المنع من التصرف بالمعدوم عقود السلم والاستصناع والإجارة والمساقاة، مع عدم وجود المحل المعقود عليه حين إنشاء العقد استحسانًا، مراعاة لحاجة الناس إليها، وتعارفهم عليها، وإذن الشرع في السلم والإجارة والمساقاة ونحوها.
وأجاز الحنابلة بيع المعدوم عد العقد إذا كان محقق الوجود في المستقبل، بحسب العادة، كبيع الدار على الهيكل أو الخريطة، وعللوا ذلك بعدم ثبوت النهي عن بيع المعدوم لا في الكتاب ولا وفي السنة، وإنما ورد النهي عن بيع الغرر، وهو ما لا يُقدر على تسليمه، سواء أكان موجودًا أم معدومًا، كبيع الفرس الهارب والجمل الشارد، وقالوا: إن الشرع صحح بيع المعدوم في بعض المواضع، فقد أجاز بيعَ الثمر بعد بُدُوِّ صلاحه، والحبَّ بعد اشتداده، والعقدُ في هذه الحالة ورد على الموجود والمعدوم الذي لم يخلق بعد، وأما حديثُ النهي عن بيع ما ليس عند الإنسان فالسببُ فيه هو الغرر، لعدم القدرة على التسليم لا أنه معدوم. انظر العقود لابن تيمية 227 - 232 و"إعلام الموقعين" 1/ 492.

১২৮০ - আমাদের নিকট বর্ণনা করেছেন মুহাম্মাদ বিন বাশার, তিনি বলেন: আমাদের নিকট বর্ণনা করেছেন আবদুর রহমান বিন মাহদী, তিনি বলেন: আমাদের নিকট বর্ণনা করেছেন সুফিয়ান ও শু’বাহ, আবদুল্লাহ বিন দীনার থেকে,
ইবনে উমর হতে বর্ণিত: রাসূলুল্লাহ সাল্লাল্লাহু আলাইহি ওয়াসাল্লাম ওয়ালা’ বিক্রয় করতে এবং তা দান করতে নিষেধ করেছেন(২)।--------------------------------------------
(১) ফকীহগণ উল্লেখ করেছেন যে, অবিদ্যমান কোনো বস্তুর ওপর চুক্তি করা বৈধ নয়, যেমন- শস্য প্রকাশিত হওয়ার আগে তা বিক্রয় করা; কারণ তা অঙ্কুরিত না হওয়ার সম্ভাবনা রয়েছে। আর যার অস্তিত্বহীন হওয়ার ঝুঁকি রয়েছে—অর্থাৎ অস্তিত্ব লাভ না করার সম্ভাবনা আছে—তার ওপরও চুক্তি বৈধ নয়, যেমন- মায়ের পেটে থাকা ভ্রূণ বিক্রয় করা, কারণ তা মৃত অবস্থায় জন্ম নেওয়ার সম্ভাবনা থাকে। তেমনিভাবে ওলানে থাকা দুধ বিক্রয় করা, কারণ এটি কেবল স্ফীত হওয়ার সম্ভাবনাও রাখে। তারা অবিদ্যমান বস্তুর লেনদেনের নিষেধাজ্ঞার মূলনীতি থেকে ‘সালাম’, ‘ইসতিসনা’, ‘ইজারা’ এবং ‘মুসাকাত’ চুক্তিগুলোকে ব্যতিক্রম হিসেবে গণ্য করেছেন, যদিও চুক্তি করার সময় চুক্তিকৃত বিষয়টি বিদ্যমান থাকে না। মানুষের প্রয়োজনের কথা বিবেচনা করে এবং তাদের মাঝে এটি প্রচলিত থাকায় ইহসান (সুবিবেচনা) হিসেবে এটি করা হয়েছে। আর শরীয়ত সালাম, ইজারা, মুসাকাত ইত্যাদিতে অনুমতি দিয়েছে।
হাম্বলী মাযহাবের আলেমগণ চুক্তির সময় কোনো বস্তু অবিদ্যমান থাকলেও যদি অভ্যাসগতভাবে ভবিষ্যতে তার অস্তিত্ব নিশ্চিত থাকে, তবে তা বিক্রয় করা বৈধ বলেছেন। যেমন- কাঠামো বা নকশা দেখে বাড়ি কেনা। তারা এর কারণ হিসেবে বলেছেন যে, কিতাব বা সুন্নাহর কোথাও অবিদ্যমান বস্তু বিক্রয়ের ওপর কোনো সুনির্দিষ্ট নিষেধাজ্ঞা আসেনি। বরং নিষেধাজ্ঞা এসেছে ‘গারার’ বা ধোঁকাপূর্ণ বিক্রয় সম্পর্কে, যা হস্তান্তরে সক্ষম নয়—তা বিদ্যমান হোক বা না হোক। যেমন- পলাতক ঘোড়া বা হারানো উট বিক্রয় করা। তারা আরও বলেছেন: শরীয়ত কিছু ক্ষেত্রে অবিদ্যমান বস্তু বিক্রয়কে বৈধ সাব্যস্ত করেছে; যেমন পরিপক্কতা প্রকাশের পর ফল বিক্রয় এবং শক্ত হওয়ার পর শস্য বিক্রয়। এক্ষেত্রে চুক্তিটি বিদ্যমান এবং অবিদ্যমান (যা এখনো সৃষ্টি হয়নি) উভয়ের ওপরই হয়। আর মানুষের কাছে যা নেই তা বিক্রয় করার নিষেধাজ্ঞার হাদীসটির কারণ হলো ‘গারার’ বা ধোঁকা, যা হস্তান্তরে অক্ষমতার কারণে, এটি অবিদ্যমান হওয়ার কারণে নয়। দেখুন: ইবনে তাইমিয়ার ‘আল-উকুদ’ ২২৭ - ২৩২ এবং ‘ইলামুল মুওয়াক্কিঈন’ ১/ ৪৯২।
(২) সহীহ হাদীস। এটি বর্ণনা করেছেন বুখারী (২৫৩৫), মুসলিম (১৫০৬), আবু দাউদ (২৯১৯), ইবনে মাজাহ (২৭৪৭), নাসাঈ ৭/ ৩০৬ এবং এটি ‘মুসনাদ’ (৪৫৬০)-এ রয়েছে।

A man [should not sell] what is not in his possession.¹
20 – Chapter: What has been reported regarding the dislike of selling and gifting the right of inheritance (al-walā')
1280 – Muḥammad ibn Bashshār narrated to us, he said: ʿAbd al-Raḥmān ibn Mahdī narrated to us, he said: Sufyān and Shuʿbah narrated to us, from ʿAbd Allāh ibn Dīnār, from Ibn ʿUmar: that the Messenger of Allāh, peace and blessings be upon him, forbade the selling of the right of inheritance (al-walā') and its gifting.²

¹ The jurists have mentioned that it is not valid to contract over something non-existent, such as selling crops before they appear, due to the possibility that they may not grow; nor over something that carries the risk of non-existence—i.e., the possibility that it may not come into being—such as selling a fetus in its mother's womb, due to the possibility that it may be born dead, or selling milk in the udder, due to the possibility of its absence, as it may be mere swelling. They have excepted from the rule prohibiting transactions involving the non-existent the contracts of salam (advance payment), istiṣnāʿ (manufacturing order), ijārah (lease), and musāqāh (sharecropping), despite the absence of the contracted subject at the time the contract is concluded, as a matter of juristic preference (istiḥsān), taking into account people's need for them, their customary practice thereof, and the Lawgiver's permission for salam, ijārah, musāqāh, and the like.
The Ḥanbalīs permitted the sale of a non-existent thing at the time of the contract if its future existence is certain according to custom, such as selling a house based on its blueprint or plan. They justified this by the fact that no prohibition of selling the non-existent is established in either the Book or the Sunnah; rather, the prohibition reported concerns the sale of gharar (uncertainty), which is that which one is unable to deliver, whether it exists or not, such as selling a runaway horse or a stray camel. They said: the Lawgiver has validated the sale of the non-existent in certain instances, for He permitted the sale of fruit after its ripeness becomes apparent, and grain after it hardens—and the contract in such a case applies to both the existing and the non-existent that has not yet been created. As for the ḥadīth prohibiting the sale of what is not in one's possession, the reason for it is gharar, due to the inability to deliver, not because it is non-existent.
