20 - Chapter on the Time of the Ihrām (Entering the State of Pilgrim Sanctity)

1770 - Muḥammad ibn Manṣūr narrated to us, Yaʿqūb — meaning Ibn Ibrāhīm — narrated to us, my father narrated to us, from Ibn Isḥāq, who said: Khuṣayf ibn ʿAbd al-Raḥmān al-Jazarī narrated to me, from Saʿīd ibn Jubayr, who said:

I said to ʿAbd Allāh ibn ʿAbbās: "O Abū al-ʿAbbās, I am astonished at the disagreement of the Companions of the Messenger of Allāh, peace and blessings be upon him, concerning the talbiyah (proclamation of pilgrimage) of the Messenger of Allāh, peace and blessings be upon him, when he entered the state of ihrām." He said: "Indeed, I am the most knowledgeable of people about that. It was only one pilgrimage from the Messenger of Allāh, peace and blessings be upon him, and it is from there that they differed. The Messenger of Allāh, peace and blessings be upon him, set out as a pilgrim. When he prayed his two rakʿahs in his mosque at Dhū al-Ḥulayfah, he entered the state of ihrām in his place of sitting, and he proclaimed the talbiyah for the pilgrimage when he finished his two rakʿahs. Some people heard that from him and preserved it from him. Then he mounted, and when his she-camel stood up with him, he proclaimed the talbiyah, and some people perceived that from him — and that is because the people were coming in groups. They heard him proclaim the talbiyah when his she-camel stood up with him, so they said: 'The Messenger of Allāh, peace and blessings be upon him, only proclaimed the talbiyah when his she-camel stood up with him.' Then the Messenger of Allāh, peace and blessings be upon him, continued on, and when he ascended the high ground of al-Baydāʾ, he proclaimed the talbiyah, and some people perceived that from him, so they said: 'He only proclaimed the talbiyah when he ascended...'"

= a vow that a person makes obligatory upon himself, and whatever was voluntary, such as sacrificial animals and offerings, then he may eat from it, give gifts from it, and give charity from it. And all of this is according to the school of al-Shāfiʿī.

Mālik said: One may eat from the sacrificial animal that he drove due to the corruption of his pilgrimage, and due to missing the pilgrimage, and from the sacrificial animal of tamattuʿ (pilgrimage performed with ʿumrah preceding it), and from all sacrificial animals, except the expiation for harm and the penalty for hunting and what he vowed for the poor.

Aḥmad ibn Ḥanbal and Isḥāq ibn Rāhawayh said: One may not eat from a vowed animal nor from the penalty for hunting, and one may eat from everything other than that. And that was narrated from Ibn ʿUmar.

And according to the Companions of Opinion (the Ḥanafī school): One may eat from the sacrificial animal of tamattuʿ, the sacrificial animal of qirān (combined pilgrimage and ʿumrah), and the voluntary sacrificial animal, and one may not eat from anything other than those.
