= وفيه من الفقه وجوب الحكم بالظاهر، وأن حكم الحاكم لا يُحِل حراماً ولا يُحرِّمُ حلالاً، وأنه متى أخطأ في حكمه فمضى، كان ذلك في الظاهر، فاما في الباطن وفي حكم الآخرة فإنه غير ماض.
وفيه أنه لا يجوز للمقضي له بالشيء أخذُه إذا عَلِمَ أنه لا يَحِلُّ له فيما بينة وبين الله، ألا تراه يقول: "فلا يأخذ منه شيئاً، فإنما أقطع له قطعة من النار" وقد يدخل في هذا الأموال والدماءُ والفروج، كان ذلك كله حق أخيه، وقد حَرُمَ عليه أخذه.
وقد أدرج الإِمام البخاري في "صحيحه" هذا الحديث تحت باب من قضي له بحق أخيه فلا يأخذه، فإن قضاء الحاكم لا يحل حراماً ولا يحرم حلالاً.
قال العيني في "عمدة القاري" 24/ 256 تعليقاً على قول البخاري "فإن قضاء الحاكم … ": هذا الكلام من كلام الشافعي، فإنه لما ذكر هذا الحديث قال: فيه دلالة أن الأمة إنما كلفوا القضاء على الظاهر، وفيه أن قضاء القاضي لا يُحرم حلالاً، ولا يُحل حراماً، وتحريرُ هذا الكلام أن مذهب الشافعي وأحمد وأبي ثور وداود وسائر الظاهرية أن كل قضاءٍ قضى به الحاكم من تمليك مالٍ أو إزالة ملك أو إثبات نكاح أو من حله بطلاق أو ما أشبه ذلك أن ذلك كله على حكم الباطن، فإن كان ذلك في الباطن كهو في الظاهر وجب ذلك على ما حكم به، ان كان ذلك في الباطن على خلاف ما شهد به الشاهدان على خلاف ما حكم به بشهادتهم على الحكم لم يكن قضاء القاضي موجباً شيئاً من تمليك ولا تحريم ولا تحليل، وهو قول الثوري والأوزاعي ومالك وأبي يوسف أيضاً، وقال ابن حزم: لا يحل ما كان حراماً ما كان حراما قبل قضائه ولا يحرم ما كان حلالاً قبل قضائه أنه إنما القاضي منفذ على الممتنع فقط لا مزية له سوى هذا.
وقال الشعبي وأبو حنيفة ومحمد: ما كان من تمليك مال فهو على حكم الباطن، وما كان من ذلك من قضاء بطلاق أو نكاح بشهود ظاهرهم العدالة وباطنهم الجراحة، فحكم الحاكم بشهادتهم على ظاهرهم الذي تعبد الله أن يحكم بشهادة مثلهم معه فذلك يجزيهم في الباطن لكفايتهم في الظاهر.
وقال الإِمام النووي في "شرح مسلم" 12/ 6: وفي هذا الحديث دلالة لمذهب مالك والشافعي وأحمد وجماهير علماء الإسلام وفقهاء الأمصار من الصحابة والتابعين =

= এতে ফিকহী মাসআলা রয়েছে যে, বাহ্যিক অবস্থার ভিত্তিতে ফয়সালা করা ওয়াজিব। বিচারকের রায় কোনো হারামকে হালাল করে দেয় না এবং কোনো হালালকে হারাম করে দেয় না। বিচারক যখন তাঁর রায়ে ভুল করেন এবং তা কার্যকর হয়, তা কেবল বাহ্যিকভাবেই কার্যকর হয়; পক্ষান্তরে অভ্যন্তরীণভাবে এবং পরকালীন বিচারের ক্ষেত্রে তা কার্যকর হয় না।
এতে আরও রয়েছে যে, যার পক্ষে কোনো বিষয়ের ফয়সালা করা হয়েছে, তার জন্য তা গ্রহণ করা বৈধ নয় যদি সে জানে যে আল্লাহ ও তার মাঝে তা হালাল নয়। আপনি কি দেখছেন না যে তিনি বলছেন: "সে যেন তার কিছুই গ্রহণ না করে, কারণ আমি তার জন্য আগুনের একটি টুকরোই বরাদ্দ করছি।" এর অন্তর্ভুক্ত হতে পারে সম্পদ, রক্ত এবং লজ্জাস্থান (বিবাহ), যা ছিল তার ভাইয়ের হক, আর তার জন্য তা গ্রহণ করা হারাম করা হয়েছে।
ইমাম বুখারী তাঁর "সহীহ" গ্রন্থে এই হাদিসটি এমন একটি পরিচ্ছেদের অধীনে এনেছেন যার শিরোনাম: "যার পক্ষে তার ভাইয়ের হকের ফয়সালা করা হয় সে যেন তা গ্রহণ না করে; কারণ বিচারকের রায় হারামকে হালাল করে না এবং হালালকে হারাম করে না।"
আইনি "উমদাতুল কারী" (২৪/২৫৬) গ্রন্থে বুখারীর উক্তি "... " এর ব্যাখ্যায় বলেন: এই কথাটি শাফিঈর বক্তব্য থেকে নেওয়া। কারণ তিনি যখন এই হাদিসটি উল্লেখ করেন তখন বলেন: এতে দলিল রয়েছে যে উম্মত কেবল বাহ্যিক অবস্থার ভিত্তিতে ফয়সালা করতে আদিষ্ট হয়েছে। এতে আরও আছে যে বিচারকের ফয়সালা কোনো হালালকে হারাম করে না এবং কোনো হারামকে হালাল করে না। এই বক্তব্যের বিশদ বিশ্লেষণ হলো—শাফিঈ, আহমাদ, আবু সাওর, দাউদ এবং সমস্ত যাহিরীদের মাযহাব হলো, বিচারক সম্পদের মালিকানা প্রদান, মালিকানা উচ্ছেদ, বিবাহ সাব্যস্ত করা অথবা তালাকের মাধ্যমে তা ছিন্ন করা বা এই জাতীয় যে কোনো বিষয়ে যে ফয়সালা দেন, তা সবই অভ্যন্তরীণ বিধানের ওপর নির্ভরশীল। যদি অভ্যন্তরীণ বিষয়টি বাহ্যিক বিষয়ের অনুরূপ হয়, তবে বিচারক যা ফয়সালা করেছেন সে অনুযায়ী তা কার্যকর হবে। আর যদি অভ্যন্তরীণ বিষয়টি সাক্ষীদের সাক্ষ্যের বিপরীতে হয় এবং তাদের সাক্ষ্যের ভিত্তিতে দেওয়া রায়ের বিপরীত হয়, তবে বিচারকের ফয়সালা মালিকানা প্রাপ্তি, হারাম হওয়া বা হালাল হওয়ার ক্ষেত্রে কোনো প্রভাব ফেলবে না। এটি সাওরি, আওযাঈ, মালিক এবং আবু ইউসুফেরও অভিমত। ইবনে হাযম বলেন: বিচারকের রায়ের পূর্বে যা হারাম ছিল তা হালাল হয়ে যায় না এবং যা হালাল ছিল তা হারাম হয়ে যায় না। বিচারক কেবল অস্বীকৃতি জ্ঞাপনকারীর ওপর রায় কার্যকরকারী মাত্র, এর বাইরে তাঁর কোনো বিশেষত্ব নেই।
শাবি, আবু হানীফা এবং মুহাম্মদ বলেন: সম্পদের মালিকানা সংক্রান্ত বিষয়গুলো অভ্যন্তরীণ বিধানের ওপর নির্ভরশীল। কিন্তু তালাক বা বিবাহ সংক্রান্ত বিষয়ে যদি এমন সাক্ষীদের সাক্ষ্যের ভিত্তিতে ফয়সালা হয় যারা বাহ্যিকভাবে ন্যায়পরায়ণ কিন্তু অভ্যন্তরীণভাবে ত্রুটিপূর্ণ, তবে তাদের বাহ্যিক অবস্থার ওপর ভিত্তি করে বিচারকের রায় (যেভাবে আল্লাহ তাদের মতো লোকদের সাক্ষ্যের ভিত্তিতে ফয়সালা করার ইবাদত নির্দিষ্ট করেছেন) তাদের জন্য অভ্যন্তরীণভাবেও যথেষ্ট হবে, যেহেতু তা বাহ্যিকভাবে যথেষ্ট ছিল।
ইমাম নববী "শরহ মুসলিম" (১২/৬) গ্রন্থে বলেন: এই হাদিসে মালিক, শাফিঈ, আহমাদ এবং সাহাবী ও তাবিঈদের মধ্য থেকে ইসলামের জমহুর ওলামা ও বিভিন্ন অঞ্চলের ফকীহগণের মাযহাবের দলিল রয়েছে।
In it there is jurisprudence regarding the obligation of judging by the outward appearance, and that the ruling of a judge does not make lawful what is unlawful nor make unlawful what is lawful, and that whenever he errs in his ruling and it has passed, that is only in the outward sense; as for the inward reality and the judgment of the Hereafter, it does not pass.

In it there is also that it is not permissible for the one who has been judged in his favor to take the thing if he knows that it is not lawful for him between himself and God. Do you not see that he says: "Let him not take anything from it, for he has only been given a piece of the Fire." This may include wealth, blood, and private parts—all of that is the right of his brother, and it is unlawful for him to take it.

Imam al-Bukhari included this hadith in his *Sahih* under the chapter: "Whoever is judged in his favor regarding his brother's right, let him not take it, for the ruling of a judge does not make lawful what is unlawful nor make unlawful what is lawful."

Al-ʿAyni said in *ʿUmdat al-Qari* 24/256, commenting on al-Bukhari's statement "for the ruling of a judge...": This statement is from the words of al-Shafiʿi, for when he mentioned this hadith he said: In it there is evidence that the community has only been charged with judging by the outward appearance, and in it is that the ruling of a judge does not make unlawful what is lawful, nor make lawful what is unlawful. The clarification of this statement is that the school of al-Shafiʿi, Ahmad, Abu Thawr, Dawud, and all the Ẓahiriyya is that every ruling a judge issues—whether transferring ownership of property, removing ownership, establishing a marriage, or dissolving it by divorce, or anything similar—all of that is according to the inward reality. If the inward reality matches the outward appearance, then what was ruled is binding. If the inward reality contradicts what the two witnesses testified to, and the judge ruled by their testimony contrary to the inward reality, then the judge's ruling does not necessitate anything—neither transfer of ownership, nor prohibition, nor permission. This is also the view of al-Thawri, al-Awzaʿi, Malik, and Abu Yusuf. Ibn Hazm said: It does not make lawful what was unlawful before his ruling, nor make unlawful what was lawful before his ruling; the judge is only an enforcer against the one who refuses, with no additional authority beyond that.

Al-Shaʿbi, Abu Hanifa, and Muhammad said: Whatever involves transfer of property is according to the inward reality, but whatever involves a ruling of divorce or marriage based on witnesses whose outward appearance is upright while their inward state is corrupt, the judge's ruling by their testimony based on their outward appearance—which is what God has commanded judging by, with the testimony of such persons—that suffices them in the inward reality, because they have fulfilled their duty in the outward sense.

Imam al-Nawawi said in *Sharh Muslim* 12/6: In this hadith there is evidence for the school of Malik, al-Shafiʿi, Ahmad, and the majority of Islamic scholars and jurists of the regions among the Companions and the Followers.
